Suspended Secretary General for the ruling African National Congress (ANC), Ace Magashule has disclosed plans to drag the party to court over his suspension.

According to News24’s Carien du Plessis, Magashule is arguing that Rule 25.70 in the ANC’s constitution is unconstitutional.

In its weekend report News24 says:

“News24 has reliably learnt the papers were served on Thursday [May 13, 2021] and are set to be lodged in court on Friday on a semi-urgent basis, and that advocate Dali Mpofu is acting on his behalf.”

The suspended SG’s new course of action challenges the ruling party’s power to suspend members accused of criminal charges.

At its 2017 National Conference, the ANC voted for a law that allows the party to suspend elected or employed representatives who are facing criminal charges but refusing to step down.

ANC’s Magasghule is facing several corruption charges linked to contracts the Free State provincial government awarded when he served as a premier.
