Kenyan Man Wins KSh Million After G4S Fired Him Unfairly
After working at G4S for more than 25 years, David Mutisya was unfairly dismissed in 2018 following accusations of insubordination.
The company claimed he failed to submit performance appraisals and properly coordinate interviews, but Mutisya argued the process was biased and violated company procedures.
He took the matter to court, saying he was denied a fair chance to defend himself.
The Employment and Labour Relations Court in Nairobi, led by Judge Stella Rutto, found that G4S had not followed due process in terminating Mutisya.
The court highlighted flaws such as a biased disciplinary panel, lack of proper investigations, and failure to give Mutisya adequate time to respond to new allegations. It ruled that the dismissal was procedurally unfair and unlawful.
As a result, the court ordered G4S to compensate Mutisya with more than KSh 2 million, covering accrued leave, one month’s salary in lieu of notice, and damages for unfair termination.
The company was also instructed to issue him a certificate of service within 14 days.
The ruling reinforced the importance of fair labor practices and respect for employee rights in Kenya.
