Justice John Okoro, Chairman of a 7-member panel, presided over an appeal hearing filed by Atiku Abubakar of the PDP. Atiku had sought to present additional evidence against President Tinubu, alleging forgery of academic records. The appeal stemmed from a previous dismissal by the Presidential Election Petition Tribunal. Atiku argued that presenting forged documents for the presidency is a significant constitutional issue. However, President Tinubu opposed this, stating it’s a pre-election matter. Atiku contended that merit issues should not be decided at an interlocutory stage. Justice Okoro emphasised that criminal matters require proof beyond a reasonable doubt.
