Jack Smith, the special counsel overseeing the prosecution against former President Donald Trump, has resigned and fled the U.S. ahead of Trump’s inauguration.
“Smith had completed his work and submitted his final confidential report on January 7, 2025,” according to official documents submitted to U.S. District Judge Aileen Cannon.
Smith, who was appointed in November 2022, was tasked with leading investigations into Trump’s alleged mishandling of classified documents and attempts to overturn the 2020 election results.
However, with Trump’s victory in the November election, Smith’s team stated they “acknowledged the validity of the cases” but could not proceed, citing the Justice Department rule against prosecuting incumbent presidents.
